Exit Your Timeshare in Australia

If you want to exit your timeshare, you have more options than many owners realise — and several of them are free. This guide explains the main timeshare exit routes open to Australian owners, how they differ by operator, and when it's worth getting a second opinion.

Why exiting a timeshare is hard

Most timeshare and holiday club contracts are long-term — some run for decades — and many don't include a simple way to walk away. Ongoing levies usually continue whether or not you travel, and resale markets for timeshare points are thin.

Owners also tend to receive confusing or conflicting information, and some are approached by exit companies asking for large upfront fees. Knowing the legitimate routes first puts you in a stronger position.

Your main exit options

Cooling-off

If you signed recently, you may still be within a cooling-off period — generally 7 days for clubs that are members of the industry body ATHOC and 14 days otherwise. Check your paperwork straight away.

Surrender or hand-back

Some operators accept a surrender of your membership, sometimes only once your account is paid up. Ask in writing.

Transfer or resale

You may be able to transfer to family or sell, though demand is often low and transfer fees may apply.

Hardship requests

If illness, age or financial hardship makes ownership unmanageable, many operators will consider a written hardship request.

Bought overseas?

Many Australians and New Zealanders bought timeshares or holiday club memberships while travelling in Thailand, Bali and other offshore destinations. These contracts are often governed by foreign law, which can limit the Australian complaint routes available.

That doesn't necessarily mean there's nothing you can do — payment method, where the contract was signed and how it was sold can all matter. A review of your paperwork is the best starting point.

How Oceana Claims helps

We always suggest trying the free routes first. Where those stall, or where mis-selling may be involved, we review your contract and give you a written summary of the options that may apply.

  • Free initial contract review
  • No cold calling — you choose the next step
  • Any fees confirmed in writing before work begins

We can't promise a particular outcome — nobody responsibly can — but we can give you a clear, honest view. Check my eligibility.

FAQ

Frequently asked questions

Start by finding your contract and checking whether you are still within any cooling-off period. After that, contact your operator in writing and ask about surrender, hand-back, transfer or hardship options. If you believe you were mis-sold, a free complaint to the operator and then AFCA may be available. A professional review can help if these routes stall.
We don't recommend it. Unpaid levies usually remain a debt under your contract and can lead to collection action, fees and damage to your credit file. Get advice on your options before you stop paying anything.
No responsible firm can guarantee an exit, cancellation or compensation. Outcomes depend on your contract, the operator and your circumstances. Treat any guarantee — especially one paired with an upfront fee — as a warning sign.
Some routes cost nothing: cooling-off cancellations, an operator's own surrender or hand-back program where offered, and complaints to AFCA. Others, such as resale or transfer, may involve costs. Our initial contract review is free, and any fees for further work are confirmed in writing before you commit.
